Verdict still not reached in Dublin family murder case
The jurors in the trial of a Dublin man accused of murdering his uncle have been sent home for a second evening failing to reach a verdict.
David Cully of Kilsane Road in Finglas admits shooting Edward O'Connor in the back but denies murdering him.
The jury of seven women and five men have been asked to consider whether David Cully was provoked into killing Edward O’Connor in December 2013.
The Finglas man admits shooting him in the back as he walked away from a 'straightener' on the Ballycoolin Road but claims he was provoked after the victim made a comment about his sister.
Following the second day of deliberations, the jury returned to ask Judge Carroll Moran for the legal definition of provocation and to see an interview David Cully gave Gardaí.
The 24-year-old says he shot his uncle "in the heat of the moment" after he made a comment about his sister that caused him to lose control.
The prosecution believes it was premeditated because he organised the fight and armed himself with a gun.
If the jurors agree he was provoked, he will be convicted of the lesser charge of manslaughter.
Deliberations will resume tomorrow morning.
