Marcelo Soza, who has sought refuge in Brazil after being removed from the case, also told Caroline Dwyer he found no evidence of a conspiracy to kill Bolivian president Evo Morales or that Michael Dwyer had any “criminal link” to the case.

The meeting between Caroline Dwyer and Marcelo Soza, whose probe lasted more than four years, features in the documentary Death of a Son - The Killing of Michael Dwyer which will be aired on RTÉ television tonight.

Michael Dwyer, Eduardo Rozsa Flores and Arpad Magyarosi were killed in a dramatic hotel raid in Santa Cruz in April 2009. Two other men were taken into custody.

The dead and arrested men were accused of being tied in with terrorist group activity against Bolivia and its president Evo Morales. Mr Dwyer’s mother has spent much of the last six years trying to find out what happened to her son. She met Marcelo Soza in Brazil and asked him was Michael executed.

“Yes, but not just Michael. His two companions also. There was no need to enter the hotel at 5am, there was no need to use such force ... because if they had wanted to so this legally … as I was the prosecutor they would have instructed me to set up the operation. I would never have allowed anyone to be killed. As a lawyer, it is clear to me this was an execution.

“From all the information I collected I could not detect any conspiracy to kill president Evo Morales. I found no evidence that Michael Dwyer had any criminal link to this case,” he said.

The documentary chronicles Caroline’s journey with her daughter, Aisling, to Bolivia. She goes to the hotel where the raid took place that resulted in her son’s death and attends the trial of the men who were captured the night Michael was killed.

She also meets with the young woman who was Michael’s girlfriend in the last few months of his life.

Death of a Son — The Killing of Michael Dwyer, made by Phoenix Films and directed by Martina Durac and Julien Behal will be shown on RTÉ 1 at 9.35pm tonight.
