School to apply to send Enoch Burke back to prison after he passes onto premises

The High Court was told today that teacher Enoch Burke has returned to Wilson's Hospital School in Westmeath and passed %through the gates% this morning.

As a result, Rosemary Mallon BL, for the school, asked Mr Justice Brian Cregan, who released Mr Burke from prison yesterday, for permission to mention the case again this afternoon when she will present an affidavit outlining what had happened this morning.

She said he had returned to the school this morning and passed the gates. "There is a security man there and there is another problem as there were quite a number of protesters who also passed into the school premises," she said.

The judge said he had been reflecting on the matter overnight and it appeared the school might have to bring a fresh motion to attach and commit Mr Burke to prison again.

He said he would hear this afternoon an application by Ms Mallon for short service of that motion along with the update on what happened today.

Mr Burke was released from prison by the judge to allow him the opportunity to prepare for a new case he is bringing related to his dismissal from the school over his conduct.
