The High Court has overturned a Labour Court ruling ordering an award-winning Dublin restaurant to pay an exploited migrant worker €86,000 in back pay.

The High Court has overturned a Labour Court ruling ordering an award-winning Dublin restaurant to pay an exploited migrant worker €86,000 in back pay.

Amjad Hussein, trading as the Poppadom restaurant in Newlands Cross, appealed the ruling which directed Muhammad Younis to be paid after working 77 hour weeks for below minimum wage.

In his judgement, Mr Justice Gerard Hogan noted the vulnerability of migrants who work without permits and are deprived of the benefits of employment legislation.

He is forwarding a copy of his judgement to the Ceann Comhairle and the Minister for Enterprise and Employment so the Oireachtas can consider the policy implications that arise from the Employment Permits Act 2003.
