Prosecution concludes evidence in Wicklow murder trial
The prosecution’s evidence in the trial of a Wicklow man accused of fatally shooting a 27-year-old, father of two in front of his partner and young son has concluded.
37-year-old Garrett O’Brien of Clover Hill, Bray denies murdering Seamus "Shay" O’Byrne in the driveway of his home at Tymon Park North, Tallaght on March 13, 2009.
He has also pleaded not guilty to a second charge of possessing a firearm with intent to endanger life on the same date.
The prosecution allege Garrett O’Brien was the hooded gunman who shot Mr O’Byrne in the back before struggling with his partner, Sharon Rattigan, who was also shot in the leg.
They argue that Mr O’Brien was part of a gang who had, for two days prior to the killing, plotted to shoot Mr O’Byrne at his home.
Lawyers for the accused have not yet indicated to the court whether they will go into evidence.
The jury in the trial which is in its fourth week at the Central Criminal Court, has been sent home while legal argument continues in its absence.
The case will resume tomorrow morning before Mr Justice Patrick McCarthy.
