€2.8m settlement in case involving child with cerebral palsy

The High Court has approved a €2.8m settlement in the case of a now 11-year-old boy who suffers from cerebral palsy after the alleged mismanagement of his birth.

The case was taken by Niall Monks from St Margaret’s, Co. Dublin, through his parents Maria and William, against the Coombe Maternity Hospital.

The court heard that his mother went into hospital in July 1997 and was induced, and it was alleged the labour and birth were mismanaged.

The hospital was sued for negligence and breach of duty, which Niall’s parents said had led to his mobility being severely impaired.

No admission of liability was made by the hospital.
