Mongolian man jailed for bottle attack
A Mongolian man who threw a broken bottle at a fellow national leaving her with permanent facial scars has been given a two-year sentence at Dublin Circuit Criminal Court.
Orgilsaikhan Bayersaikha (aged 24) of Custom Hall Apartments pleaded guilty to assault causing serious harm to Ms Erdenne Bolormaa on April 3, 2005 at Gardiner Place.
Judge Katherine Delahunt noted that Bayersaikha had failed to appear for his original sentence date in April and was arrested on foot of a bench warrant.
She said she was taking into account the the fact that Bayersaikha has paid €8,000 in compensation to his victim. She noted Bayersaikha had consumed a lot of alcohol and believed that a third party had acted “inappropriately” towards his girlfriend at the party.
Judge Delahunt imposed a two year sentence and suspended the final year on strict conditions.
Garda Allan McCarthy told Mr Remy Farrell BL, prosecuting, that Bayersaikha arrived at a party at Ms Bolormaa's home and was escorted out by her as he was intoxicated and in aggressive state.
Bayersaikha threatened to to stab a friend of Ms Bolormaa and invited another to come out onto the street for a fight. As he left he knocked over a number of bins.
Garda McCarthy said Bayersaikha was in possession of two bottles and swung one of them at a nearby person. Ms Bolormaa heard a bottle smashing and it then hit her in the face.
Ms Bolormaa was treated in hospital but has been left with scars to her face.
Garda McCarthy said Bayersaikha had no previous convictions.
Defence counsel, Mr Conor Devally SC, said that Bayersaikha was now married with one child who suffers from a congenital heart defect. He said his wife and child had returned to Mongolia to seek medical treatment for the child.
Mr Devally said Bayersaikha was genuinely remorseful for his actions.
