Man charged with schoolboy’s manslaughter granted bail
Paul Barry, aged 38, of Pearse Street appeared in Cloverhill District Court yesterday morning alongside his young brother Michael Barry, aged 23, from Pigeon House Road, Ringsend, who has been charged with possession of a hockey stick. A large number of friends and relatives of Nigerian boy Toyosi Shittabey attended the court hearing.
Toyosi Shittabey’s father Bolanle was in court – along with others who knew the 15-year-old teenager, who was fatally stabbed on Good Friday at Mount Eustace Crescent, Tyrrelstown, Dublin.
Detective Garda Tom Conney from Blanchardstown Garda Station objected to bail for Paul Barry. The garda told Judge William Earley that his objection was based on evidence and the seriousness of the charge.
Mr Barry’s defence solicitor, while admitting there was evidence against his client, said this was not a reason to refuse bail.
Judge Earley granted bail with €300 of Paul Barry’s own bond plus two independent sureties of €30,000 each.
The older brother was ordered to reside at Pearse Street, surrender his passport and not to apply for a new one. He was also told to sign on at Pearse Street Garda Station daily, to stay out of the Dublin 15 area as well as not to contact any witnesses in the case.
Mr Barry, who appeared in court with one arm in a sling and with some bruises, was ordered to reappear before Cloverhill District Court on April 20.
Meanwhile, the court heard how his younger brother Michael – charged with possession of a hockey stick as an offensive weapon – was expected yesterday to be in a position to meet his own separate bail requirements.
