Man remanded in custody over Waterford death
Andrew Foley, a single, unemployed man, was charged with assault causing harm to Thomas Jordan in a flat on William Street in the city on March 16, 2005.
Mr Foley is originally from Dunshaughlin in Co Meath but has been living in Waterford for some time.
Det Garda Finbarr O’Sullivan told Judge William Hartnett the accused was arrested and charged with assault under Section 3 of the Non-Fatal Offences Against the Person Act at 5.15pm on St Patrick’s Day.
It is understood that Mr Foley presented himself at Waterford Garda Station in the early hours of the morning following the fatal assault. He was held for questioning throughout St Patrick’s Day before being charged.
“He made no reply after caution,” Det Gda O’Sullivan told the court.
Thomas Jordan, a 49-year-old father-of-two died after a fight broke out in the block of flats where both he and the accused resided.
It remains unclear how the fight started.
The deceased came from a well-respected family in the St John’s Park area of the city and was known locally for his involvement in athletics.
He lived in Portlaw, Co Waterford, but separated from his wife and returned to live in the city.
Further charges are likely to follow when the results of a post mortem become available.
Mr Foley appeared in court yesterday dressed in a grey tracksuit bottoms, runners and a beige fleece. He stood briefly before Judge Hartnett to confirm he was not working and to request free legal aid.
Solicitor for the accused Brian Chesser said he was not making an application for bail at this time. He was remanded in custody to appear again before the court on Wednesday March 23 next.
