Certain farmers who do not hold an automatic allocation right to the Basic Payment Scheme which has replaced the Single Payment Scheme can avail of the Scottish Derogation, or Fruit and Vegetable Provision.

The Scottish Derogation can cater for persons who never held Single Payment entitlements, but who actively farmed in the beef, dairy, sheep or arable sectors in 2013, and who can provide verifiable evidence of such production on May 15. 2013.

The Fruit and Vegetable Provision can cater for persons who grew fruit and/or vegetables in 2013 on at least one hectare.
