FARMERS have welcomed a reduction in the SAC river margin and a new compensation deal for bogs in the Department of the Environment’s new agreement with farm organisations on the European Communities (Natural Habitats) Regulations 1997.

In the case of SAC rivers, the designated habitat part of the river margin will, except where special features are present, extend only to 2.5 metres from the river bank. However, activities outside this area which could impact on the SAC will require consultation with and consent from conservation staff.

The agreement arose from a commitment in Sustaining Progress that the Government would review all aspects of the European Communities (Natural Habitats) Regulations 1997, under which Special Areas of Conservation (SACs) and Special Protection Areas (SPAs) are designated.

Environment Minister Martin Cullen said he will make it clear to local authorities that, as set out in recent draft planning guidelines for rural housing, the approach should be to allow sustainable rural development, while maintaining designated areas at a favourable conservation status.

IFA has interpreted this to mean that SAC designation will not be a reason to turn down planning permission for housing in rural areas. ICMSA said it is important that this principle is extended to forestry or wind-farm development on designated land.

Mr Dillon expressed disappointment that operation of REPS in SAC, NHA (Natural Heritage Area), SPA and commonage areas, including the Shannon Callows, has not been resolved.

It was agreed that prior to publication of proposed SPAs for Hen Harrier, there will be further consultations with the farming organisations about the extent of these areas and their implications for wind-farming and forestry.
