Another week at Gorse Hill for O’Donnells as judge adjourns case

Solicitor Brian O’Donnell and his wife Mary Pat will remain at Gorse Hill over the weekend and into next week.

The Court of Appeal has today adjourned without deciding whether or not to overturn the High Court trespass order against O’Donnell over the Gorse Hill mansion in South Dublin property.

Mr O’Donnell has challenged the validity of the documents appointing receiver Tom Kavanagh to the property.

He claims the documents should be rendered invalid - because Bank of Ireland employee Nicola Coyle signed them "underhand" instead of them being sealed and her signing as a witness to that seal.

Cian Ferriter for the Bank of Ireland argued that there is no doubting the binding nature of the document.

The plaintiffs have been told to submit the original documents to the court by next Monday - with a final ruling now expected later next week.

Ms Justice Mary Finlay Geoghegan yesterday said that Brian O’Donnell’s appeal must be finished today.

She said today that the court is anxious to finalise the matter - and will sit for a maximum of 10 minutes each side on Tuesday, with a ruling due later in the week.
