Dublin City Council sues Priory Hall developer
Dublin City Council is suing developer Tom McFeely over Priory Hall, despite the fact that he is bankrupt.
The council is either a lessee or mortgagee of 35 apartments in the North Dublin development.
Dublin City Council is seeking damages from Mr McFeely and his former company Coalport over the defective apartments at Priory Hall.
The North Dublin development had to be evacuated last year because it was a fire hazard.
However, Mr McFeely's bankruptcy means that in order to initiate legal action the Council had first to get permission to proceed from the bankruptcy, which Judge Ms Justice Elizabeth Dunne granted.
Barrister Denis McDonald said DCC was a lessee of 27 apartments in Priory Hall and a mortgagee of eight.
He explained that the reason they are chasing Mr McFeely is that it is still possible that he may overturn his Irish bankruptcy.
