Jury told they can return a majority verdict

The jury in the trial of man who has been charged with capital murder after the death of a Garda Sergeant have been told that they can now return a majority verdict.

The trial judge has told the 11 jury members that they must reach a decision of at least 10-1 on all three charges against the accused Dublin man, Daniel O’Toole.

Mr O’Toole has been charged with arson, murder and capital murder after the death of Garda Sergeant, Andrew Callanan at Tallaght Garda Station.

After just under four hours of deliberations yesterday the jury was sent to a hotel for the night and they returned again this morning at 11am when they were told that they had been deliberating for long enough to warrant a majority verdict.

As there are only 11 jury members instead of the usual 12, a majority of 10-1 is the only acceptable outcome.
