A belligerent man shouted “silence, silence, silence” into the face of a garda who asked for his name and later when gardaí were going through his pockets as part of a routine search he urinated in his pants.

The incident started when a woman in a dressing gown ran out on to Washington St in Cork City and flagged down a Garda patrol car claiming that her partner had attacked her.

Garda Donal Daly told Cork District Court that he and Garda Bryan Murphy got out and saw Remigiusz Walus, aged 44, coming out of 23 Washington St in a highly intoxicated condition.

Garda Daly aid he asked Walus for his name and he replied, ā€œsilenceā€. Asked a second time for his name he muttered something incoherent.

ā€œI asked him for a third time and he approached me and screamed ā€˜silence, silence, silence’ in my face.

ā€œHe was arrested and taken to the Bridewell Garda Station where he did not calm down for a while. We had to keep him in the cell for one and an half hours.

ā€œHe began to urinate when we were searching his pockets.ā€

Garda Daly said the accused was belligerent and threatening on Washington St that night but his partner did not want to go ahead with making a complaint of being assaulted.

Walus pleaded guilty to being drunk and a source of danger, refusing to give his name, and engaging in threatening behaviour. Judge Leo Malone imposed fines totalling €500 and a three-month suspended jail sentence.

Inspector Pat Meaney said that among the defendant’s 19 previous convictions were five counts of engaging in threatening behaviour, which Judge Malone described as five too many, adding: ā€œI would have thought he might have learned from his past experiences.ā€

Eddie Burke, defence solicitor, said: ā€œHe had some drink. He brought a friend home. His partner did not appreciate this and took umbrage. They had a row. She left the house, annoyed with him for taking home this person.

ā€œHe was trying to trying to calm her down and quieten her and that is why he was saying ā€˜silent’ to the guard. He lived with this lady for a long time.

ā€œIn relation to not giving his name, he felt that the guards knew his name and address.

ā€œHe is on medication for depression and should not have been drinking. He is doing a course at the moment in musical instrument making and he does a lot of busking.ā€
