The Employment Appeals Tribunal (EAT) has ruled that a care home provider "acted reasonably" when sacking a care assistant for gross misconduct.

The EAT report records that care assistant, Majella Flavin was sacked for gross misconduct in 2011 and the grounds were abuse of a service user, gross negligence and erosion of employment relationship due to diminished trust and confidence. No address was given for Ms Flavin at the EAT, but she had worked at the care home operated by Cheshire Ireland at Rathfredagh near Newcastle West in Co Limerick since 2003.

The facility caters for people with a variety of conditions including brain injuries, MS and locked-in syndrome.
