Garda and two others on affray charge

An off-duty Garda, his brother, and another man, accused of getting involved in a street fight last summer, have appeared in court in Limerick.

Garda and two others on affray charge

Adrian Joyce, aged 31, from Claremorris in Co Mayo, appeared before Limerick District Court yesterday charged under Section 16 of the Public Order Act.

Garda Joyce, who is based at Dublin’s Pearse St Station, is accused of causing an affray by using, or threatening to use, violence at O’Connell St in Limerick city on Jul 7 last year.

His brother Nicholas Joyce, aged 40, with an address at Warrington, Lancashire in England, and David McCarthy, aged 27, from Merval Drive, Clareview, Limerick, also appeared in court charged with the same offence.

Sergeant Gerard Staunton gave evidence of charging the three men at Henry St Garda Station.

The court heard they gave no reply to the charge.

Insp Seamus Ruane told the court the DPP has elected for summary disposal of the matters, which means they will be dealt with in the district court.

There was no objection to bail and the State did not seek any special bail conditions.

Judge Eugene O’Kelly remanded each of the accused on bail on their own bond of €500.

Solicitor Elizabeth Hughes represented the Joyce brothers, while solicitor John Herbert appeared on behalf of Mr McCarthy.

Both solicitors sought disclosure of documents and any CCTV footage that may be available.

Judge O’Kelly adjourned the cases for six weeks and remanded the accused men on bail to appear before the same court again on Apr 2.
