Man had cannabis buried in his back garden

Robert Fedyna, aged 48, who was living on Cove St at the time of the offences on Jun 8, 2012, pleaded guilty to having the drugs for sale or supply.

Garda Des Cogan said that some of the drugs, a weighing scales, and €1,500 in cash were found during a search of the house when gardaí went there on that date with a warrant.

In a further search of the back garden they found a further quantity of cannabis buried in a container.

The total value of drugs seized was €9,300.

At first in yesterday’s sentencing hearing the defendant said the cash was not the proceeds of drug dealing and he did not want it forfeited to the State.

Judge Seán Ó Donnabháin gave the defence a brief adjournment for Fedyna to consider his position.

After this period, defence barrister Ray Boland said he was consenting to forfeiture of the cash to the State.

The judge said he was considering a 12-month jail sentence on the basis that the defendant was dealing drugs in a considerable quantity. Mr Boland asked the judge if he would remand the accused in custody until Jul 30 and revisit the sentencing at that stage.
