Pair charged with murder of student

A youth and a 16-year-old are to stand trial accused of the murder of German student Thomas Heinrich, who died following a stabbing in Dublin in December.

The postgraduate degree student was stabbed in his stomach and suffered a severed artery during an incident outside his apartment at St Anthony’s Rd, Rialto, on Dec 1.

His friend Robert Rinker, aged 22, also suffered life-threatening injuries.

Within days, investigating gardaí questioned two youths in connection with the incident.

Yesterday, they were arrested and taken to Kilmainham Garda Station. They were both charged with the murder of Mr Heinrich at 74-76, St Anthony’s Rd, Rialto, on Dec 1, and assault causing serious harm to Mr Rinker at the same location.

The pair were brought before Judge John O’Connor at Dublin Children’s Court.

Wesley Kelly, aged 19, of St Anthony’s Rd, was the first to be called.

Detective Sergeant Michael McNulty said the unemployed youth “made no reply to each charge after caution.

Defence solicitor Ann Brizzell, applying for bail in relation to the serious assault charge, asked for it to be fixed with strict conditions, including an order for her client to stay away from potential witnesses.

Judge O’Connor refused bail on the assault charge and Mr Kelly, who was granted legal aid, was remanded in custody to appear again next Wednesday.

He shook his head when asked him if he knew what was happening and Judge O’Connor then explained that, after hearing legal arguments, he had decided he was not letting him have bail.

Mr Kelly spoke at the end of the hearing to give his date of birth, then nodded to the judge and was let speak briefly with his mother and sister before he was led out of the courtroom. He is to be held on remand at St Patrick’s Institution pending a possible High Court bail application.

A few minutes later, the 16-year-old was brought into the courtroom.

Det Sgt Michael O’Brien gave details of his arrest.

Judge O’Connor refused to grant bail and the boy was remanded in custody to appear again on Tuesday.

Mr Quinn said the teen is anxious to sit his Leaving Certificate exams, which begin on Wednesday. A High Court bail application is to be brought next Tuesday ahead of his appearance at the Children’s Court.

The teenager, who was granted legal aid, looked over at his parents and smiled before mumbling “okay” when the judge made his order. He spoke to confirm his date of birth.

He is to be held on remand at Trinity House detention centre.

After the hearing, his mother left the courtroom in tears.
