A 91-year-old man appeared in court yesterday, on charges of assault, obstruction of a garda in his duty, and being abusive and insulting to staff at a nursing home.

Niall O’Mahony previously indicated to the court that he will not contest the charges.

Mr O’Mahony, of Ardkilmartin, Kilmallock, Co Limerick, is charged with separate offences, which gardaí claim occurred at Maria Goretti nursing home in Kilmallock on dates in January and February this year.

It’s alleged he assaulted a member of staff at the nursing home on Jan 10. He is also charged with engaging in abusive behaviour to a garda and staff at the nursing home on Feb 25. He is also charged with obstructing a garda officer on the same date.

The pensioner, who eats his dinner at the nursing home, resides at his home, which is situated beside the elder care facility.

He first appeared in court on Friday, Mar 1, when Judge Mary Larkin explained to him that gardaí had brought charges against him. After consulting with his client, counsel for Mr O’Mahony said they could proceed with the case and indicated a plea of guilty.

Judge Larkin fixed bail on the defendant’s own bond of €300 and adjourned the case to yesterday.

During yesterday’s court sitting, Inspector Paul Reidy, Askeaton Garda station, said the Director of Public Prosecutions had yet to furnish gardaí with directions in the case.

Judge Larkin adjourned proceedings to Apr 19 when it is expected the case will be finalised.

Mr O’Mahony was present for yesterday’s brief court hearing and used the aid of a walking stick as he entered and exited the court.
