A LIMERICK-based solicitor is to face trial by a jury on a charge of alleged fraud, a court has heard.

Denis McMahon, 57, with an address at Pembroke road, Dublin appeared at Limerick District Court yesterday to face charges that in November 2002, at the offices of McMahon O’Brien Downes Solicitors, Henry Street, Limerick, he induced Margaret Duggan to give him a bank draft for €7,500 with the intention of making gain for himself or another, contrary to Section 6 of the Criminal Justice (theft and fraud) Act.

Detective Garda Margaret Nagle gave evidence of arresting and charging McMahon on September 1.

Brian McInerney, BL, for McMahon, told Judge Eamon O’Brien the charge would be vigorously and fully contested and defended.

Insp Jerry Horan said the DPP had directed that the case be dealt with by way of trial on indictment at the Circuit Court. There was no objection to bail.

The case was put back to November 23.
