Two solicitors struck off roll

SOLICITOR John B McGylnn, who misappropriated €200,000 and left deficits of nearly €600,000 in client accounts, was struck off the solicitors’ roll by the president of the High Court Mr Justice Richard Johnson yesterday.

The judge also struck off a second solicitor, Kieran McCarthy, trading as McCarthy and Associates, who was suspended last week from his practice for late filing of accounts, after he admitted a second offence relating to dealing with a client’s tax liability.

John B McGlynn, of Castle Street, Athlone, Co Westmeath, admitted 28 offences, including misappropriation of clients’ monies. The offences were discovered in July 2005.

Striking off Kieran McCarthy of Maryborough Lodge, Douglas, and Watergold Buildings, Douglas, both Cork, Mr Justice Johnson rejected a plea not to do so.

Mr McCarthy had last week been suspended from practicing by the court for filing his accounts 17 months too late with the Law Society.

The judge deferred a decision on whether to lift that suspension until yesterday when he was told Mr McCarthy had been found guilty of a second offence of a number of failures in relation to the payment of a client’s capital acquisition tax.
