Property tycoon fails to comply with order
The Ansbacher account holder, who has been a witness at the Moriarty and Mahon tribunals, responded to the enforcement order by lodging a fresh planning application for a revised schedule of works on the road in the coastal village of Fenit in Kerry.
Mr Byrne originally received planning for the site 11 years ago and it remains unfinished with an unpaved road, no lighting and no footpaths.
A spokesperson for Kerry County Council has confirmed that the council served the enforcement order on Mr Byrne on February 8 ordering him to complete the road, footpath and lighting on the 11-house estate by March 24. The order told Mr Byrne that failure to complete the works may lead to a prosecution which could result in a fine or €12,697 and/or a two-year jail sentence.
A spokesman for Complete Contract Management (CCM), a company retained by Mr Byrne on the project, confirmed no works have taken place on the site since the enforcement order was served.
CCM said their sole response has been to lodge a fresh planning application for revised works. Kerry County Council said that because of pressure on resources they have not been able to inspect the site since the deadline for the completion of works expired.
