Aer Lingus seeks to restrict rights

AER LINGUS GROUP PLC yesterday got its first chance to tell a European court why it should freeze larger competitor Ryanair Holdings Plc’s shareholder voting rights in Aer Lingus for as much as two years.

Aer Lingus seeks to restrict rights

Aer Lingus appealed to the European Court of First Instance in November after the European Commission refused to order Ryanair to dispose of its 29% stake in Aer Lingus. The carrier yesterday sought to restrict Ryanair’s rights pending the court’s ruling in the main appeal.

“A favourable decision on interim measures would effectively dispose of the case as Ryanair would either have to sell their shares or be prevented from doing anything with them,” said Sebastian McMichael, a senior solicitor with British law firm Shepherd & Wedderburn LLP.
