DCC financial officer agrees letter on sale of shares was misleading

THE chief financial officer of DCC has agreed before the High Court that a letter, which he had requested a Dutch director of a DCC Dutch-registered subsidiary write, gave an incorrect impression about who had suggested the calling in early February, 2000, of a boardmeeting of the Dutch subsidiary to discuss the possible sale of the DCC stake in Fyffes.

Fergal O’Dwyer of DCC plc and the sole Irish director of the DCC Dutch-registered subsidiary, Lotus Green Ltd, said he believed tax “was in his mind” when he had asked Henri Roskam, a Dutch director of Lotus Green, to write a letter to Mr O’Dwyer on January 31 2000 recording the content of a phone conversation held some 40 minutes earlier between Mr O’Dwyer and Mr Roskam.
