Prosecutors in the case against Robert Downey Jr say they're close to agreeing a plea bargain with his lawyers which could stop him from going back to prison.

Downey's appearance in a Californian court was the first time he's been seen in public since he checked himself into a rehabilitation centre in April.

He was arrested in a Los Angeles alley on suspicion of being under the influence of cocaine.

The actor is reported to have looked fit and smartly dressed in a dark blue suit, white shirt and tie.

His lawyers said he would plead not guilty to charges stemming from his arrest in November for possession of Valium and cocaine.

He is now due to appear in court again on July 16.

Deputy district attorney Tammy Capone has now admitted discussions are under way with the defence on a plea bargain.

"We are getting really close," Capone said.
