Judge to view CCTV footage of alleged robbery in Cork before deciding on jurisdiction

A 19-year-old man accused of carrying out a robbery on another man outside a shop in Cork city centre had the case against him adjourned so that CCTV of the incident can be shown to the judge at Cork District Court.

Sergeant John Kelleher said at Cork District Court that Nathan O’Callaghan of 5 The Rise, Sweetfield, Youghal, County Cork, was charged with robbery and that the DPP directed that the case was suitable to be dealt with summarily at Cork District Court, rather than by judge and jury at the circuit court.

Sergeant Kelleher gave an outline of the allegations so that Judge Mary Dorgan could decide on whether or not she too would accept jurisdiction.

The charge relates to the alleged robbery of a man at Spar, Parnell Place, on May 28 2023.

“It is alleged that Nathan O’Callaghan and another person approached the injured party outside Spar on May 28, 2023, at 3.44pm. It is alleged that both males assaulted him by punching him to the head and face.

“The injured party fled into Spar and was pursued by Nathan O’Callaghan who proceeded to further assault him and rob him of €70 cash and earphones valued €40, and this property was never recovered.

“There is excellent CCTV of the entire incident. The DPP has directed prosecution on one count of robbery,” Sgt. Kelleher said.

Judge Mary Dorgan asked if there was a medical report on the injured party. Sgt Kelleher said there was no medical report but that the information on the garda file was that the victim was not seriously injured.

Judge Dorgan said that she would like to see CCTV of the incident before deciding on whether or not she would accept jurisdiction to deal with the case at district court level.

The case was adjourned until September 30 for playing of the CCTV of the incident.
