A 35-year-old man was remanded in custody on Thursday in a case where he is accused of giving a woman on crutches a “flying kick” as she was leaving hospital.
The accused man appeared at Cork District Court by video link from prison. Details of charges against him were outlined when he appeared at an in-camera sitting of the court last week.
Initially, the accused man was granted bail at a special sitting of Cork District Court on Saturday, July 6, on a charge of breaching a Protection Order. Judge Mary Dorgan noted that on this occasion the accused man was given a “last chance warning”.
Garda Barry O’Shea then outlined the alleged breaches of the same order on two occasions since.
It was alleged that at 11pm on July 9 at Mercy University Hospital the woman was leaving the hospital on crutches and that the defendant grabbed one of her crutches and struck her in the leg with it. It was further alleged that he ran towards her and give her a flying kick in the stomach.
He also allegedly grabbed her aggressively by both arms putting her in fear.
The court was also told that on July 10 — the day after the hospital incident — while the young woman was chatting to others on Lapp’s Quay at around lunchtime, the defendant leaned his head into her face and appeared to spit into her face, putting her in fear.
Bail was revoked and he was remanded in custody until Thursday when Judge Dorgan remanded him in continuing custody until July 25.
The parties cannot be identified as the alleged breaches of the protection order are prosecuted under the Domestic Violence Act.
The defendant was represented in court by solicitor Shane Collins-Daly. Sergeant Gearóid Davis indicated that new charges were being brought against the accused.
