Convicted murderer Joe O'Reilly will find out today whether he can apply to have his conviction for the murder of his wife declared a miscarriage of justice.

The Director of Public Prosecutions has taken steps to stop his latest appeal, claiming it is an abuse of process.

The 42-year-old is serving life for the murder of his wife Rachel at their home in the Naul in North Dublin in 2004.

He several interviews to the media in the wake of Rachel's death and appeared on the Late Late Show.

He's always maintained he's innocent of his wife's murder. He was convicted by a jury in 2007 and later lost an appeal.

He is now trying to have his conviction declared a miscarriage of justice on the basis that part of the book of evidence was left in the jury room during his trial.

The Court of Appeal will decide today whether the appeal can proceed.
