Accused to challenge legality of detention

The High Court is today due to hear an application from two Dublin men challenging the legality of their detention.

Martin Kelly, aged 46, from Artane and 35-year-old William Clare from Coolock were arrested earlier this week before being charged with Real IRA membership at a special sitting of the Special Criminal Court on Wednesday night.

Both have strenuously denied the charges.

Their application to have their detention declared illegal was due to be heard yesterday, but the case was adjourned when the men’s lawyers objected to being searched by Gardai before entering the court.

The lawyers claimed the Gardai were conducting the searches arbitrarily.
