Sligo driver found not guilty of causing baby’s death in Fermanagh

When the unanimous verdict was given before Justice Madam McBride, Ryan Cox’s parents Katriona and Peter Cox wept and shook their heads in disbelief.
John Fahy, aged 25, Grogagh, Grange, Co Sligo, denied a charge of causing the death of Ryan Cox by driving without due care and attention, at Boa Island Road on January 14, 2013.
He also denied causing grievous bodily injury to Katriona Cox .
By their verdict, the jury found that they accepted John Fahy’s account and rejected the prosecution case that either by over steering or inexperience that he had driven into the path of Mrs Cox’s car.
It was the prosecution’s case that Mr Fahy lost control of the borrowed Renault Megane as he approached a left hand bend and struck Mrs Cox’s car on her side of the road.
Ryan, who was strapped in a baby chair in the back of his mother’s car, died in the South West Hospital, Enniskillen, later that day.
