A man charged with murdering his partner’s son has been refused a bail application to travel to Spain.

David Mahon, aged 44, is charged with murdering Dean Fitzpatrick, aged 23, on May 26, 2013, at Northern Cross on Dublin’s Malahide Rd.

Mr Mahon, of Ongar Village, Clonsilla, appeared at the Central Criminal Court yesterday where he applied to have his bail conditions varied to allow him to take a two-week trip to Spain.

Under his bail conditions, Mr Mahon must sign on at a Garda station three times a week and relinquish his passport.

The court heard that Mr Mahon had been granted a similar application that allowed him to travel to Spain in September but Ms Justice Margaret Heneghan refused on this occasion.

The court heard from Det Sgt Eddie Carroll of Coolock Garda Station, who told Justice Heneghan he feared Mr Mahon is a flight risk.

Ms Justice Heneghan said she was taking into account Det Sgt Carroll’s concerns that the trial is near to starting and that this heightened the flight risk. “I am not disposed to grant his bail request based on what I have heard at this point,” she said.

Mr Mahon’s trial is due to start in April 2016.
