‘Scarred-for-life’ woman has damages claim thrown out

A woman claimed she would be scarred for life after she lacerated her left leg against a plant pot while celebrating her birthday on the dance-floor of a Dublin nightclub.

However, Circuit Court President Mr Justice Raymond Groarke threw out the €38,000 damages claim of Aisling Comey, aged 27, against the Everleigh Garden nightclub, of Harcourt St, Dublin.

Judge Groarke said that it remained unexplained as to how Ms Comey suffered a deep 5cm horizontal laceration to her lower leg, but CCTV evidence clearly showed there was no plant pot where she and her friends had been dancing.

Ms Comey, of St Attracta Rd, Cabra, Dublin, said the wound had left a permanent visible scar of which she was very conscious.

Ms Comey had sued Holtend Ltd, which trades as the Everleigh Garden, with a registered address at Glendenning House, Wicklow St, Dublin, for negligence.

The judge said Ms Comey suffered a horrible injury which had left her with a nasty scar.

However, he said, she had failed to prove her claim.
