25-year-old charged with unlawfully killing man outside pub
Det Garda Niall Hayes arrested Luke O’Sullivan, aged 25, of 23 Inchera Lawn, Mahon, Cork, and brought him before Cork District Court yesterday.
Mr O’Sullivan made no reply when he was charged, that on Sept 22, 2012, at Avenue de Rennes, Mahon, Cork, he did unlawfully kill Pat Deasy, contrary to common law.
Insp Bill Duane said the State’s application was to adjourn the case for six weeks to allow time for preparation and service of a book of evidence.
There was no Garda objection to the accused being remanded on bail on certain conditions.
Those conditions included a curfew to be home at Inchera Lawn every night between 10pm and 7am; sign on three days a week at Anglesea St Garda Station; surrender his passport by Jun 16, and not apply for a replacement; and abstain from intoxicants.
A further condition states that he would have no contact, direct or indirect, with the family of the late Pat Deasy, who was 57.
Solicitor Frank Buttimer was appointed to represent Mr O’Sullivan on free legal aid. He said the 25-year-old was receiving unemployment benefit.
Mr Buttimer said that by agreement with the prosecution, signing on and curfew and living at home conditions would be relaxed between Jun 8 and 15 for what the solicitor described as a pre-arranged overseas visit.
Judge Leo Malone adjourned the manslaughter case until Jul 12 for preparation and service of a book of evidence.
It is anticipated that on that date or a later date, the case will be sent forward for trial, possibly at the October sessions of Cork Circuit Criminal Court.
