Bail revoked as men broke curfew
Both accused face charges of engaging in a violent disorder and producing a weapon during the incident. Only one of them is charged with assault causing serious harm.
Garda Stephen Fuller applied at Cork District Court yesterday to have bail revoked for both men. Judge Leo Malone acceded to the applications and remanded both of them in custody until Jan 10.
Shane Cotter, aged 20, of 27 Annmount Cross, Friars Walk, Cork, is accused of assault causing serious harm to Jorje Roca, 40, at White Street, Cork, on Jan 23, 2012.
Cotter is also accused of engaging in a violent disorder at the same time and place. The final charges against him are for producing a golf club and a wooden replica of a samurai sword.
The only two charges against Danny O’Brien, 20, of 10 Brandon Court, Dillon’s Cross, Cork, are for engaging in a violent disorder and producing a golf club.
Garda Fuller testified that Cotter breached curfew conditions by being out on Dec 15, 16 and 22, at times he was required to be at home.
Cotter told solicitor, Eddie Burke, that he wanted to be admitted to a unit of the Mercy hospital because, he said: “My head is all over the place.”
O’Brien was required in December to sign daily at Mayfield Garda station and he failed to sign any day, according to Garda Fuller.
O’Brien also breached his curfew conditions on Dec 22, 26 and 30, and on Jan 1.
