A FATHER and son accused of the manslaughter of an Irish student in the United States have won a temporary stay on their trial after convincing a court to consider dismissing all charges against them on a technicality.

The family of 20-year-old Catherine Kinsella from Baltinglass, Co Wicklow, who drowned off Cape Cod over two years ago, have been given no indication as to when or if a trial will now proceed.

Catherine died after she fell from the deck of a charter cruise boat, the Sea Genie II, during a party on board on July 22, 2001. The boat’s captain, Joseph Shore, 64, and his son, Mitchell Shore, 40, a crew member, were charged with manslaughter after witnesses gave alarming accounts of the events surrounding her death.
