Cork company served with winding-up petition
Dublin registered Briggs Roofing & Cladding Limited took the legal action against John F Supple, the developers of the five-star Castlemartyr Capella Hotel in Cork.
It is understood that the action was taken after John F Supple failed to settle a debt relating to work at the Capella hotel.
However, a spokesman for John F Supple said yesterday that the matter has been resolved.
He said there was a “breakdown in communication” between the two firms which was mainly due to the builders’ holiday.
“The matter has been fully resolved and activities at John F Supple fully resumed after the builders’ holidays,” said the spokesman.
He added that John F Supple is embarking on contracts worth €39 million over the coming six months.
If a company is owed money and it has been refused or neglected to be paid the debt, it may apply to wind-up the firm in question by presenting a petition to court for that purpose.
A winding-up petition is usually presented by a creditor on the grounds that the company cannot pay its debts and this has to be proved to the court.
In this case the petition was directed to be heard before the High Court next Wednesday.
