FARMERS have been urged to review their wills to ensure that their wishes as regards the transfer of their farm business are implemented.

IFA Farm Business Committee chairman Eddie Downey said the EU single farm payment is not legally attached to the land and does not automatically transfer with land. “The single payment is attached to the farmer and is treated as a separate asset. The payment could end up in the residue of the will and in certain circumstances could be lost by the family,” he said.

Mr Downey said a person who wants a family member or members to inherit the farm and also the single payment should clearly state this in the will.
