Magnier, Fergie dispute in High Court
Neither were in Court No 7 of the High Court when a motion by Mr Magnier for particulars of Mr Ferguson’s claim was mentioned.
However, Mr Justice Kevin O’Higgins was told by counsel for Mr Magnier, Mr David Barniville BL, that the motion could be struck out with costs to Mr Magnier. The judge then struck out the motion.
The motion was brought as a preliminary to the main action over the stud fees which is unlikely to be heard for several months and maybe not until next year.
The Magnier side sought an order under the rules of the Superior Courts directing Sir Alex to furnish particulars sought by Mr Magnier’s solicitors by a notice for particulars dated December 22 last.
An order was also sought that in the event of a failure to furnish the particulars sought within the time limited by the court that the Ferguson claim be struck out.
