Nicotine patch warning ruling

PLC, maker of Nicoderm anti-smoking patches, won a ruling that warning labels on nicotine patches sold in California don’t have to say the products cause harm to fetuses, as required by state law.

The California Supreme Court said US Food and Drug Administration labeling requirements pre-empt rules under the state’s Proposition 65, which requires warnings on dangerous substances.
