Eli Lilly Prozac bid ‘should fail’

Eli Lilly & Co’s appeal to protect research data on antidepressant Prozac should be rejected by the European Union’s highest court, a court aide said.

Eli Lilly sought to block Teva Pharmaceutical Industries Ltd, the world’s largest generic drugmaker, from using research information on the liquid form of Prozac to launch a generic version. Francis Jacobs, an aide at the European Court of Justice, said the data shouldn’t be protected.
