PRENUPTIAL agreements are not binding in Britain, a court has ruled, but agreements made by a couple after their wedding can be enforced.

The Judicial Committee of the Privy Council ruling came in the case of an American couple, Roderick and Marcia Macleod, who live on the Isle of Man.

Some lawyers had hoped the case would validate prenuptial agreements — especially those made in the US, where courts have recognised their validity. But the British court said it could not reverse the rule that such agreements are contrary to public policy.
