EU flag needs to be taken down a peg
They are jumping the gun on this.
It is still the case that the EU is nothing more than an international organisation, established by treaty between sovereign states. Those states have agreed to be bound by its decisions, as a form of international arbitration, but legally the EU remains the servant of the member states, not their master.
