Man charged with two counts of rape and one count of sexual assault sent for trial

A man facing two charges of rape and one charge of sexual assault against the same alleged injured party has been sent for trial to the current sittings of the Central Criminal Court.
Detective Garda Aisling Keating told Bandon District Court a book of evidence had been served on the accused, who cannot be named to protect the identity of the alleged injured party.
Det Garda Keating said the Director of Public Prosecutions (DPP) had directed the prosecution should proceed by trial on indictment to the current sittings of the Central Criminal Court on Parkgate Street, Dublin.
Judge Joanne Carroll outlined the charges to the accused man. She said it was alleged he raped the injured party at a location in Co Cork on a date in 2011 and on the same date it was alleged he also sexually assaulted the injured party.
She said it was also alleged he raped the same injured party at a location in Dublin on a date in 2012. The judge warned the accused if he intended to rely on an alibi as part of his defence, he must notify the prosecution within 14 days.
Defence barrister Alan O’Dwyer, acting for Kevin Tunney solicitors, requested legal aid and the provision of one junior and one senior counsel for the trial, which was granted.
A Section 56 order for the release to the defence of any copies of recordings of questioning of the accused by Garda Síochána was also authorised.
The accused was remanded on continuing bail with conditions on his own bond of €500.
