Accused was arrested by gardaí in Cork at lunchtime on Wednesday for being in possession of diamorphine (heroin) and crack cocaine, and having both drugs for the purpose of sale or supply to others.

A young Dubliner was seen dealing crack cocaine and heroin in Cork City at lunchtime on Wednesday, it was alleged on Thursday at Cork District Court.

Cian Whelan, 21, of no fixed address in Dublin, was arrested by Detective Garda Michael Abernethy and charged with four counts under the Misuse of Drugs Act, namely being in possession of diamorphine (heroin) and crack cocaine, and having both drugs for the purpose of sale or supply to others.

The detective objected to bail being granted to the accused at Cork District Court and outlined the grounds for that objection. Defence barrister Patrick Horgan said the accused would comply with any bail conditions and would give gardaí an address at which he would reside.

The detective said addresses at which the defendant said he was welcome to stay had been checked out by gardaí in Dublin and it was established he was not welcome at those properties.

Det Garda Abernethy said, “On June 18, at around 1pm, I was on patrol at Lower Glanmire Road, Cork, when I observed a male in a suspicious transaction with two other males. On seeing gardaí, he tried to walk away.

“He was stopped and searched. He was found in possession of four deals of suspected diamorphine, five deals of crack cocaine and a small quantity of cannabis. He had €515 in cash and a black iPhone.

“The nature of the evidence is that Cian Whelan was caught red-handed.

“Given his drug use and the lack of any structure in his life due to chronic addiction at the moment, I don’t believe he is capable of appearing in court on his own.

“I believe that if granted bail he would commit further offences, including drug offences to feed his drug habit.”

Judge Mary Dorgan refused bail and remanded Cian Whelan in custody until June 24.
