Enoch Burke outside Co Westmeath school for second day after prison release

Enoch Burke arrived outside Wilson's Hospital School in Co Westmeath for the second day in a row, having been released from prison earlier this week.

Mr Burke was again prevented from entering the school grounds by a security guard.

He was released from prison on Wednesday to prepare for a case launched against an appeals body due to review his dismissal from the school.

The judge said the decision was being made on the basis that he would not attend the school, and he would be brought back to prison if he did.

Mr Burke arrived at the school on Thursday and again on Friday morning. 

He has been in jail since late November for breaches of a court order directing him not to trespass at Wilson’s Hospital School, where he worked as a teacher.

Last week, he sought a temporary injunction against a disciplinary appeals body tasked with reviewing his dismissal from the school.

Before the High Court on Wednesday, Mr Justice Brian Cregan said Mr Burke had raised “substantive” and “credible” issues in papers prepared against the Disciplinary Appeals Panel (DAP).

The judge said he was directing that Mr Burke be released from prison for “one reason and one reason only”, in the interest of the administration of justice and so that he has time to prepare for his case against the DAP.

On Thursday, barrister Rosemary Mallon told the High Court that less than 24 hours after being released from prison, Mr Burke had returned even though the court made it abundantly clear it was to allow him to prepare for a new case he was bringing over his dismissal from the school and that he was not to trespass.

Mr Justice Cregan granted Ms Mallon permission to serve the proceedings via Mr Burke's email address and adjourned the matter to tomorrow afternoon.

The judge said he "would expect to see you and/or Mr Burke" at the court on Friday. 

Mr Burke arrived at the school at approximately 9am this morning, when parents and children were arriving for the day.
