Two take to High Court to challenge marriage referendum Yes vote

The High Court will be asked later today for leave to challenge the result of the marriage referendum.

Two separate cases will be heard by High Court President Nicholas Kearns.

One of the challengers is Gerry Walshe, an electrician from Co Clare. The other is Maurice Lyons, a gardener from Co Kilkenny.

They have brought separate applications but both are seeking injunctions preventing the issuing of a certificate verifying the referendum result while their legal challenges are being heard.

First they need to get permission from the High Court to continue their cases against the State and the Referendum Commission.

It is understood there will be claims that referendum was not impartial in relation to how monies were allocated and that the amendment would create uncertainty and conflict with the Christian ethos of the Constitution.

The referendum was passed last month with 62% supporting a Yes vote.
