The Court of Criminal Appeal has reserved judgement in a motion brought by a Dublin man who was convicted of murder for acting as the getaway driver for the gunman of a fatal shooting.

The Court of Criminal Appeal has reserved judgement in a motion brought by a Dublin man who was convicted of murder for acting as the getaway driver for the gunman of a fatal shooting.

In November 2009, Liam Bolger (aged 26) was jailed for life by Mr Justice Paul Carney after a Central Criminal Court jury found him guilty of the murder of Christopher Barry (aged 25) on September 13, 2008.

The father of one, with a last address of Homelawn Gardens in Tallaght, had denied the murder at Byrne's bookmakers on Killester Avenue in Donnycarny.

The jury of six men and six women agreed with the prosecution case that although Bolger was not the actual assassin, he shared equal responsibility for the murder by driving the gunman away from the area of the shooting in his white Renault van, and the case was one of joint enterprise.

The trial heard that Christopher Barry had a conviction for a drugs offence and had been associated with a feud between Crumlin and Drimnagh criminal gangs.

The court also heard that Liam Bolger's father was shot dead in a pub in Clanbrassil Street in Dublin city centre in 1994.

In March of this year Bolger failed in an appeal against his conviction for murder.

Counsel for Bolger, Mr Michael O’Higgns SC, this morning told the Court of Criminal Appeal that the applicant was seeking an order setting aside the March 14 judgement of the appeal court.

He argued that two grounds of the appeal were not dealt with in the judgement because of an oversight by the court.

Chief Justice Susan Denham, presiding, said the court would reserve its judgment.
