State lawyers at Ian Bailey's extradition appeal have today raised objections to new evidence which criticises the garda investigation into the murder of Sophie Toscan du Plantier.

State lawyers at Ian Bailey's extradition appeal have today raised objections to new evidence which criticises the garda investigation into the murder of Sophie Toscan du Plantier.

They say gardaí are objecting to the documents being opened publically in court without a right of reply.

On the third and final day of this appeal, Mr Bailey's lawyers were expected to outline new evidence in which a former DPP criticised gardaí's handling of the investigation into Ms du Plantier's death.

However Senior Counsel for the State Robert Barron has asked the five-judge court to first decide the case on the other legal issues raised in the course of the appeal.

If that is refused, he is seeking an adjournment until tomorrow to allow gardaí a right of reply. He told the court gardaí would rather not have a public spat with the DPP.

Concern has also been raised about a letter from the French Magistrate which stated that if Ian Bailey is extradited, the murder investigation can continue.

The question is whether Ireland can surrender a person for investigative purposes in the absence of a confirmed prosecution.
