Court grants legal aid to Dundon brothers

Two Limerick brothers who are charged with threatening to kill three members of the same family have been granted legal aid at the Special Criminal Court.

John Dundon (aged 29) with an address at Hyde Road, Limerick, is charged with threatening to kill a mother and her daughter at an address at Ballinacurra Weston during two separate incidents on the weekend of April 3 and 4 last.

His older brother Wayne Dundon (aged 33), of Lenihan Avenue, Limerick, is charged with threatening to kill a man at an address in Limerick city on September 30, 2010.

Mr Justice John Mac Menamin, presiding at the Special Criminal Court, said the court would approve legal aid for the accused as the State had raised no objection to the application.

The application for legal aid was deferred earlier this month after the non-jury court found both men had filed documentation particular to the District Court which was not suitable for the purposes of the Special Criminal Court.

Mr Justice Mac Menamin, sitting with Judge Alison Lindsay and Judge William Hamill, said the court would fix a hearing date for February 21, 2011, with a date for mention also scheduled for October 5, 2010.

Counsel for the accused, Mr Shane O’Callaghan BL, said that both men would likely make a bail application in the interim.

Mr Justice Mac Menamin remanded both men in custody to appear before the court on October 5 next.
